上訴法庭法官楊振權頒發上訴法庭判案書：
1987年12月至1988年1月期間，位於新界粉嶺流水響道的長興發木廠被黑社會份子勒索。當木廠東主拒絕繳付 ‘保護費’後，木廠被人縱火破壞，導致經濟損失達90,000元。
事後申請人蕭運平因懷疑涉案而被捕。經調查後，申請人被控一項勒索罪及一項縱火罪。申請人否認控罪。
1988年5月，案件交由當時的地方法院法官李美度士審理，申請人有律師代表。
1988年5月21日，雙方律師結案陳述前，申請人棄保潛逃。李美度士法官在申請人缺席下，裁定申請人勒索罪名不成立，但縱火罪名成立。李美度士法官亦在申請人缺席下，判他入獄3年。
2002年11月9日，申請人在深圳被當地公安局逮捕。2002年11月9日至2003年4月16日期間，申請人被深圳公安局關押在龍崗看守所。
2003年4月16日，申請人被移交給香港警方及被帶上區域法院。法官裁定申請人要服李美度士法官在1998年所判的3年刑期。
7. 申請人現要求本庭批准他就刑期提出逾期上訴。
申請人並非指稱被判的3年刑期過長。他指出在棄保潛逃期間（他）被國內公安拘押160天，而李美度士法官在判刑時，沒有將該拘押期考慮在內。
當然李美度士法官在判刑時，不可能將上述拘押期考慮在內。申請人是在李美度士法官判刑後才被深圳公安拘押。
10. 本庭需考慮的是應否因申請人被拘押160天而將其被判之刑期減短。
- 申請人向本庭呈遞了兩份證明書，都是由深圳巿公安局坪地派出所發出的。第一份證明書日期是2003年5月15日，其手寫內容如下：-
“証明：2002年11月10日，我所在深圳巿明都酒（樓）將涉嫌香港通緝在逃的真實姓名簫運平捕獲，並予2002年11月11日被深圳巿公安局龍崗分局刑事拘留。特此証明。”
12. 第二份證明書日期是2003年7月29日，其打印內容如下：-
“証明：2002年11月9日，我所將香港警方通緝嫌疑人（真實姓名蕭運平）抓獲，并于2002年11月11日刑事拘留，我所于2003年4月16日移交香港警方。蕭運平在2002年11月11日至2003年4月16日期間關押在龍崗看守所。特此証明。”
當案件在2003年9月9日提訊時，代表律政司署的政府律師陳小姐向法庭表示需就申請人在國內被拘押的指稱作出調查。
今天代表律政司署的李鏡鏞律師向本庭表示，控方仍未能確定申請人在2002年11月9日至2003年4月16日被深圳公安局拘押的原因。但他同意根據上述證明書的內容，申請人看來是因為本案受通緝及被國內公安拘押的。
本庭需指出，根據《刑事訴訟條例》第57A條，法庭只有權將一名被定罪犯人的某些被拘押期，從其刑期中扣減。
16. 申請人被深圳公安局拘押的時間，並非是可扣減的拘押期。
但有案例顯示，法庭是有權將被告人因棄保潛逃而在國內被拘押的情況考慮在內，以決定適當的刑期（見HKSAR v Lau Pak Lok [1997] 3HKC 650）。
雖然，申請人面對的困境全因他意圖逃避罪責所造成，屬咎由自取；申請人逃避罪責長達15年後，才被緝獲。他的行為亦不值得鼓勵；他指稱要照顧父親的說法亦並非是求情因素；但考慮到李鏡鏞高級政府律師所作的讓步，本庭同意將申請人在國內被拘押的部份時間，作為刑期一部份。
以申請人的罪行而言，3年刑期是適當的，但本庭將申請人在國內被拘押期的一半，即約3個月，計算在刑期內。
為了達到上述目的，本庭批准申請人就刑期提出逾期上訴。本庭判上訴得直，3年的刑期減為2年9個月。
